Operating Conditions for services provided by Condor del Caribe, S.A. de C.V.).
1 - PERSONAL INFORMATION REQUESTED
Condor del Caribe, S.A. de C.V. will request personal information from all the people who use our online and call center services, in order to process, follow-up, and confirm the service(s) hired from Condor del Caribe, S.A. de C.V. The information requested from the users includes, but is not limited to: full name, e-mail address, mailing address, postcode, birth date, credit card information and additional information for the reservation and payment processes. The credit card information is used for the payment process during the hiring of the services provided by Condor del Caribe, S.A. de C.V.
When filling the registry forms or giving the information to any representative of the call center, the information owner gives full and voluntary consent to providing the personal information that may be requested on the understanding that in case that the user decides not to share any of the mandatory information he/she will not be able to access the services which necessitate such information; nonetheless, will be able to access all the other services provided inasmuch as the personal information is not required. Condor del Caribe, S.A. de C.V. in no case and in no circumstance will keep, store, nor file any sensitive personal information such as race, ethnicity, health status, genetic information, religion a/o belief, membership to any union or such group, political conviction, sexual preference, etc.
Furthermore, Condor del Caribe, S.A. de C.V. compiles the e-mail addresses of all the people that use these services to communicate with Condor del Caribe, S.A. de C.V., the additional information regarding the web pages visited through their visit to the website, and any other information given voluntarily, including but not limited to polls, surveys, or online registry forms.
The information provided as a user of the website may be utilized to: contact the user provided that any change on the reservation is made, detect a/o prevent possible cyber-crimes, to make customer surveys and polls, manage the customer-company relations and improve the website's content. In the case that the user provides Condor del Caribe, S.A. de C.V. with its phone number, it will be used as a means of communication in the event that any change in the reservations is made, or in any concern related to the payment process.
The personal information that, as a user of our website a/o Call center, is provided to Condor del Caribe, S.A. de C.V. must be true and in accordance with your present situation.
2 - DATA TRANSFER
Personal data may be transferred a/o shared with trading partners, associates, suppliers; financial, banking and credit institutions, subsidiary partners, subsidiaries, affiliates, branches and third parties such as hotels, leasing companies, airlines, tour suppliers, etc., to verify and confirm the reservation(s) made.
3 - PRIVACY AND PERSONAL DATA PROTECTION
Condor del Caribe, S.A. de C.V. establishes and maintains administrative, technical and physical measures in order for the safekeeping of personal data from: damage, loss or alteration, destruction or misuse, breach or unauthorized processing.
Condor del Caribe, S.A. de C.V. commits to keep the user's information undisclosed, and will not transfer the information to any third party unless prior consent from the user; with the exceptions mentioned on the Federal Law on Protection of Personal Data Held by Private Parties in its art.37; as well as executing the Data Transfer in observance of the present Law.
Article 37. Domestic or international transfers of data may be carried out without the consent of the data owner in the following cases:
1- Where the transfer is pursuant to a Law or Treaty to which Mexico is party;
2- Where the transfer is necessary for medical diagnosis or prevention, health care delivery, medical treatment or health services management;
3- Where the transfer is made to holding companies, subsidiaries or affiliates under common control of the data controller, or to a parent company or any company of the same group as the data controller, operating under the same internal processes and policies;
4- Where the transfer is necessary by virtue of a contract executed or to be executed in the interest of the data owner between the data controller and a third party;
5- Where the transfer is necessary or legally required to safeguard public interest or for the administration of justice;
6- Where the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding,
7- Where the transfer is necessary to maintain or fulfill a legal relationship between the data controller and the data owner.
4 - USE OF IMAGES
Condor del Caribe, S.A. de C.V. reserves the right to take photographs throughout the duration of the trip or part thereof, and to use the resulting photographs to promote our services. By booking with Condor del Caribe, S.A. de C.V., trip members agree to allow their images to be used in such photographs. Trip members who prefer that their images not be used are asked to identify themselves to the Condor del Caribe guides before and at the beginning of the trip.
5 - USE OF BANK CARD INFORMATION LIABILITY
Condor del Caribe, S.A. de C.V. commits to respect the privacy of all its customers; in the particular aspect of this website, to all those who make online booking or book through the Call center. In order to ensure the safety of all the online operations a SSL certificate is used in its website, which protects the data sent from the user's web navigator onto Condor del Caribe, S.A. de C.V.'s website and databases. All the information regarding the transactions made with a credit card is ciphered in order to keep the user's information safe and private.
All the personal information provided by Condor del Caribe, S.A. de C.V. customers, such as full name, mailing address, e-mail address, telephone number, and any other data concerning the booking through the online payment process, will be considered as strictly confidential, unless specified otherwise by the customers.
6 - USE OF "COOKIES" AND IP ADDRESSES
Condor del Caribe, S.A. de C.V.'s data server will send data to the user's web navigator, same that will be stored in the user's computer hard drive. This allows Condor del Caribe, S.A. de C.V. to identify the devises employed by the user to access to its portal. This whole process is known as the use of "cookies" or IP address. Through the use of these "cookies" or IP address Condor del Caribe, S.A. de C.V. is able to offer a personalized service to all its users for it permits, among other things, to issue publicity and promotion campaigns, measure the online audience and traffic in its websites visited by the user. Through these "cookies" or IP address the user is not personally identified, what is identified is the public IP address from where the user is accessing the website.
7 - LIABILITY CLAUSE
Condor del Caribe, S.A. de C.V. responsibility for the compliance of the services offered in this agreement explicitly stating that liability is limited, as it acts as an intermediary between passengers and their Travel agents on the one hand and on the other between people and companies called to provide tourist services, such as Transport Companies, Hotels, Restaurants, Other Agencies Operators, etc..
Therefore we accept no responsibility for lost or forgotten objects, theft, accidents, delays and other force majeure or irregularities that may arise and affect passengers and their belongings. Whether these are caused by third parties or due to causes beyond our control.
If for any of the reasons indicated the Tour operator is forced to remove part of the services included in your travel plans, passengers may not claim more than the refund of the amount paid for the service(s) that are not provided, excluding any damage or interest.
8 - MODIFICATION OF THE PRIVACY POLICY
Condor del Caribe, S.A. de C.V. reserves the right to modify or amend totally or partially the present Privacy Policy if necessary; such amendments will be valid upon the date of publication in its website
9 - ACCEPTANCE OF THE TERMS
Upon subscribing to any service published in this agreement all of the above conditions, policies and responsibilities are accepted.
10.1 - TRANSFERS CANCELLATION POLICIES
Cancellations made two (2) day prior to arrival date will be penalized with 100% of the total amount paid.
Cancellations made three (3) or more days prior to arrival date will not be penalized.
No show or no arrival will be penalized with 100% of amount paid
10.2 - EXCURSION CANCELLATION POLICIES
Full refund will apply in the following cases:
1. When the service is canceled by the supplier.
2. Due to illness, presenting a doctor's report. (Excluding any charge generated by banking transactions).
3. The Cancellation or date change is made prior to 11:00 am the day before the service. (Excluding any charge generated by banking transactions).
In case of No Show No refunds will be applied.
10.3 - JOURNEY CANCELLATION POLICIES
Cancellations will cause the following charges:
1- 100% when we receive cancellation one (1) to seven (7) days prior to the output of the tour or in case of No Show days.
2- 50% when received eight (8) to fifteen (15) days prior to the departure. Excluding all flights that are part of an itinerary purchased from Condor del Caribe and any charge generated by banking transactions.
In case of cancellation by the agency due to force majeure, the clients can subsequently use the services purchased up to a maximum period of 12 months after the cancelation or if the client wishes the corresponding reimbursement is made.
10.4 - HOTEL RESERVATIONS CANCELLATION POLICIES
Cancellations will cause the following charges:
1- 100% when we receive cancellation one (1) to seven (7) days prior to the output of the tour or in case of No Show.
2- 50% when received eight (8) to fifteen (15) days prior to the departure. (Excluding any charge generated by banking transactions).
10.5 - FLIGHT CANCELLATION POLICIES
The cost of all flights (national and international) none refundable.
This includes all flights that are part of an itinerary purchased from Condor del Caribe.
11 - INSURANCE
An insurance is included only when passengers are in transit.
We offer broader coverage at additional cost.
12 - IMPORTANT INFORMATION
- It is advisable to reconfirm your tickets with the airline two days before your return flight.
- We recommend you arrive at the airport 3 hours before international flights and 2 hours before domestic flights.
- At some airports departure taxes are collected, they must be paid in person at the time of check-in.
- In the event of a strike or inability of the carrier to facilitate transportation reserved, the sole liability of the operator is to provide guidance and assistance to passengers.
- To ensure arrival transfer, when included, we would appreciate notification any change in the flight details.
- It is the responsibility of the passenger to have necessary documentation for their trip, including a valid passport, visas and vaccinations.
- Passengers are subject to the decisions of the immigration authorities in each country, so that the operator has no responsibility for the consequences of actions of that body.
